Assam Labour Department exempts working hours in factory and Shops and Establishments

The Assam Labour Department on May 08, 2020, exempts all adult worker of all factories from the provision of section 51 (Weekly hours), 52 (Weekly holidays), 54 (Daily hours) and 56 (Spreadover) of the Factories Act and from the provision of section 6 of the Assam Shops and Establishments Act, 1971, which specifies daily and weekly hours, with effect from May 08, 2020 to deal with the exceptional pressure of work due to COVID-19 pandemic.

Therefore:

1. Total number of hours of work in any one day shall not exceed twelve hours

2. The spread over, inclusive of intervals for rest shall not exceed thirteen hours in any one day.

Employers and employees may mutually agree to extension the working hours upto a maximum of 12 hours, subject to payment of overtime wages to the employees or workers. The mutual agreement will remain valid upto maximum of 3 (three) months from the date of issue or withdrawal of this Notification whichever is earlier.

Necessary protocol for social distancing and personal hygiene must be maintained strictly at work places.
