Madhya Pradesh exempts industries from the provision of Industrial Disputes Act, 1947

The Madhya Pradesh Labour Department on May 05, 2020, exempts industries of the state from the provisions of the Industrial Disputes Act, 1947, for next 1000 days from the date of publication of this Notification in the Madhya Pradesh Gazette.

The exemption is not available for the provisions of Chapter V-A (Lay-off and retrenchment) and section 25-N (Condition precedent to retrenchment of workmen, 25-O (Procedure for closing down an undertaking), 25-P (Special provision as to restarting of undertakings closed down before commencement of the Industrial Disputes (Amendment) Act, 1976), 25-Q (Penalty for lay-off and retrenchment without previous permission) and 25-R (Penalty for closure) of chapter V-B.

The above mentioned exemption will be given to those industries who have made adequate provisions for the investigation and settlement of industrial disputes of the workmen employed by them.

Further, this Notification will be applicable to those new industries which will be registered in the Factories Act, 1948 and start production for the first time in the next 1000 days after the publication of this Notification.
