MoHFW suspends specific clauses of Preconception and Pre-natal Diagnostic Techniques (Prohibition of Sex Selection) Rules

The Ministry of Health and Family Welfare (MoHFW) on April 04, 2020, has decided to suspend the implementation of specific clauses of Rule 8, Rule 9(8) and Rule 18A(6) of the Preconception and Pre-natal Diagnostic Techniques (Prohibition of Sex Selection) Rules, 1996 till June 30, 2020 due to COVID-19 pandemic.

The followings are the Rules suspended for the specific time-period:-

  • The Rule 8 specifies the 'Renewal of Registration', where an application for renewal of certificate of registration shall be made to the Appropriate Authority thirty days before the date of expiry of the certificate of registration.
  • The Rule 9(8) specifies the “Maintenance and preservation of records”, where every Genetic Counselling Centre, Genetic Laboratory, Genetic Clinic, Ultrasound Clinic and Imaging Centre shall send a complete report in respect of all pre-conception or pregnancy related procedures or techniques or tests conducted by them in respect of each month by 5th day of the following month to the concerned Appropriate Authority.                                
  • The Rule 18A(6) specifies the Code of Conduct to be observed by all the appropriate authority including the State, District and Sub-district, shall submit the quarterly progress report to the Government of India through State Government and maintain Form H for keeping the information of all the registrations made readily available.

The Ministry has noticed that the compliances of the Rules are causing difficulty due to the outbreak of COVID-19 pandemic. Thus, the implementation of the above-mentioned Rules is suspended, which will have retrospective effect that is from the date of the lockdown, till June 30, 2020.
