Kerala Tax Department publishes the Kerala Foreign Liquor (Approval of Label) (Amendment) Rules, 2020

The Kerala Tax Department on March 20, 2020 has published the Kerala Foreign Liquor (Approval of Label) (Amendment) Rules, 2020 to further amend the Kerala Foreign Liquor (Approval of Label) Rules, 2018.

The following amendments in the Kerala Foreign Liquor (Approval of Label) Rules, 2018 are as under:

 In Rule 4 which specifies the particulars in labels:

i. in sub-rule (1), clause (iva) has been inserted, namely: if intended to be affixed on glass bottle, print ‘GLASS BOTTLE’.

ii. clause (xi) has been substituted, namely: the warning in English and Malayalam ‘CONSUMPTION OF ALCOHOL IS INJURIOUS TO HEALTH—മദ്യപാനം ആര ാഗ്യത്തിന് ഹാനിക ം’ and ‘BE SAFE—DON’T DRINK AND DRIVE—മദ്യപിച്ചു വാഹനം ഓടിക്കാതി ിക്കൂ—സു ക്ഷിത ാകൂ’. The warning shall be printed horizontally in letters of size not less than 3 mm, inside a square box.

iii. after clause (xi), after the existing proviso the following proviso has been inserted, which specifies that the changes made as per clause (xi), in labels shall be approved as per these rules. The labels affixed on the bottles before the changes came into existence do not need to be approved.

iv. in sub-rule (2)(b), the following clause has been substituted, namely: When Indian Made Foreign Liquor is manufactured and exported to places in India outside the State, the words “NOT FOR SALE IN KERALA” and when exported to places outside India, the words “IMPORTED FROM INDIA” shall be printed in contrasting colour in the label to be affixed on each bottle, each letter having not less than 3 mm.

 In Rule 6 which specifies the procedure for approval of labels:

i. Sub-rule 3 has been substituted: A fee of Rs. 50,000 (Rupees fifty thousand only) Shall be levied for approval of each kind of labels.

ii. after sub-rule (3), the following proviso has been inserted, namely: Provided that such fee shall be Rs. 25,000 (Rupees twenty-five thousand only) for each label which is intended to be affixed on the glass bottles.

iii. sub-rule (4) has been inserted, namely: (4) Notwithstanding anything contained in these rules, labels approved before the date of commencement of the Kerala Foreign Liquor (Approval of Label) Amendment Rules, 2020 shall again be got approved from the Excise Commissioner with the statutory warning as stipulated in clause (xi) of sub-rule (1) of rule 3. No fee shall be levied for the approval of label due to any change made in the statutory warning alone. The above waiver of fee shall be limited to one time.
