Government of Tamil Nadu issues the Draft Amendments to the Minimum Wages (Tamil Nadu) Rules, 1953

The State Government of Tamil Nadu on March 18, 2020 issues the Draft Amendments to the Minimum Wages (Tamil Nadu) Rules, 1953.

The amendments are as under:

Ø  Under Rule 21(4) which specifies the time and conditions of payment of wages and the deductions permissible from wages, after the second proviso, the following proviso shall be added, namely:

Provided also that no separate registers in Forms I (Register of fines) and II (Register of deductions for damage or loss caused to the employer by the neglect or default of the employed persons) need be maintained if the particulars required to be maintained therein are contained in any other records maintained by the employer under any other labour Law.

Ø  Under Rule 26(2) which specifies that a worker is entitled for extra wages for overtime, proviso has been added, namely:

A register showing overtime payment shall be kept in Form IV (Overtime register for workers). Overtime work shall be entered up in the register before the expiry of 24 hours from the commencement of such work:

Provided that no separate register in Form IV need be maintained if the particulars required to be maintained therein are contained in any other records maintained by the employer under any other labour law.

The draft amendment will be taken into consideration on or after the date of expiry of three months from the date of publication of this notification in the Tamil Nadu Government Gazette (March 18, 2020).  Objection or Suggestion, if any, should be addressed in duplicate to the Secretary to Government, Labour and Employment Department, Fort St. George, chennai-600 009 through the commissioner of Labour, chennai-600 006.
