Government of Tamil Nadu publishes the Tamil Nadu District Municipalities (Amendment) Act, 2020

The State Government of Tamil Nadu on February 15, 2020 publishes the Tamil Nadu District Municipalities (Amendment) Act, 2020 to further amend the Tamil Nadu District Municipalities Act, 1920.

The amendments are as under:

 In section 3 which specifies Definitions:

i. under Clause 7-A: Chairman, Clause 12-C: Municipal Council, Clause 29-A: Third Grade Municipality or Town Panchayat, the word “Third Grade Municipality” has been omitted. 

ii. Clause 29-AA: Transitional area, has been omitted.

 Chapter-IA on “Third Grade Municipalities” has been omitted.

 The words “III Grade Municipalities and town panchayats” or “Third Grade Municipality” appears has been substituted with the words “Town Panchayat”.

 Omission of Section:

i. Section 375 which specifies the Transitory provision, has been omitted. 

ii. Section 376 which specifies special provision in respect of Third Grade Municipalities and validation, has been omitted.

 Under Section 50(1) which specifies the Disqualification of Councillors:

i. the expression “clauses (b) and (c) of sub-section (2) of section 3-C or” shall be omitted;

ii. The expression “(a) becomes of unsound mind” has been substituted, namely: “(b) becomes of unsound mind;”

The Tamil Nadu District Municipalities (Amendment) Ordinance, 2019 is hereby repealed. Notwithstanding such repeal, anything done or any action taken under the principal Act, as amended by the said Ordinance, shall be deemed to have been done or taken under the principal Act, as amended by this Act.

Clause (b) of section 10 shall be deemed to have come into force on November 12, 2019 and all the remaining provisions of this Act shall be deemed to have come into force on January 06, 2011.
