Government of Madhya Pradesh amends the Madhya Pradesh Sand (Mining, Transportation, Storage and Trading) Rules, 2019

The State Government of Madhya Pradesh on February 07, 2020, amends the Madhya Pradesh Sand (Mining, Transportation, Storage and Trading) Rules, 2019.

The amendments are as under:

 Under Rule 7(2) which specifies the calculation for fixation of the preliminary base price (upset price), proviso has been added, namely:

Provided that, based on the estimation of the demand for sand for calculating the initial base price of a group , a different quantity can also be determined from the total sum of the quantity of all the mines.

 Under Rule 11(1) and (2) the period for depositing the tender amount has been substituted as “15 working days” instead of “3 working days”.

 Rule 13(2) which specifies the procedure for execution of agreement, has been substituted where the requirement for submission of surety bonds for each quarry in Form-VI is omitted.

 Under Rule 26(2) which specifies the provision for transition period, clause (b) has been inserted, namely:

All statutory clearances of sand mines transferred to Panchayats will be transferred in favor of the new group contractor. For this, the Chief Executive Officer of the janpad area of the concerned Panchayat is authorized to issue No Objection Certificates (NOCs) or consent to the capacity of transferor in the mines transferred under the earlier rules to the Panchayat.  

This Notification shall be deemed to have come into force from August 30, 2019.
