The Competition Commission of India (CCI) on November 20, 2019, notifies the Competition Commission of India (General) Amendment Regulations, 2019 to further amend the Competition Commission of India (General) Regulations, 2009.

The followings are the amendments made in the Competition Commission of India (General) Regulations, 2009:-

 A new Regulation 10(2)(da) related to ‘Contents of information or the reference’ has been inserted, namely:-

“Details of litigation or dispute pending between the informant and parties before any court, tribunal, statutory authority or arbitrator in respect of the subject matter of information”

 In Regulation 35(1) related to ‘Confidentiality of the identity of an informant on a request made to it in writing’, a proviso has been inserted, namely:-

“Provided that where it is expedient to disclose the identity of the informant for the purposes of the Act, the Commission shall do so after giving an opportunity to the informant of being heard."

 Regulation 35(10) has been substituted, namely:-

“The Director General has rejected the request of the party made under Regulation 35(2), the party may approach the Commission for a decision regarding confidential treatment within a period not exceeding 30 days from the receipt of the order passed by the Director General.”

 Regulation 49(1) has been substituted, namely:-

“Each information received under Section 19(1)(a) of the Act from any person shall be accompanied by proof of having paid the fee as under:-

1. Rs. 5000 in case of individual or Hindu Undivided Family (HUF), or

2. Rs. 10,000 case of Non-Government Organisation (NGO), or Consumer Association, or a Co-operative Society, or Trust, or

3. Rs. 40,000 in case of firm (including proprietorship, partnership or Limited Liability Partnership) or company (including one person company) having turnover in the preceding year upto rupees two crore, or

4. Rs. 1,00,000 in case of firm (including proprietorship, partnership or Limited Liability Partnership) or company (including one person company) having turnover in the preceding year exceeding rupees two crore and upto rupees 50 crore;

5. Rs. 5,00,000 in the cases not covered under clause (a) or (b) or (c) or (d).”
