FSSAI issues letter regarding online sale of alcoholic beverages by e-commerce food businesses

The Food Safety and Standards Authority of India (FSSAI) on November 15, 2019, issues letter regarding online sale of alcoholic beverages by e-commerce food businesses under FSSAI license. FSSAI had laid down standards for alcoholic beverages as food item and grants license for alcoholic beverages through Food Safety and Standards (Alcoholic Beverages) Regulations, 2018. In the recent judgement of the Karnataka High Court on the matter related to online sale of liquor or alcohol, it was held that the petitioner was not entitled to carry on business of online order processing and delivery of liquor to the consumers in the State of Karnataka.

Thus FSSAI has directed licensing authorities to take self declaration from Food Businesses Operators (FBOs) for applying e-commerce kind of business for Category 14 namely ‘Beverages excluding Dairy products’ that they won’t display and sell liquor or alcoholic food beverages online. The E-commerce-FBOs are directed to submit the permission or No Objection Certificate (NOC) from Excise Department of concerned states if they intend to sell liquor or alcoholic beverages online.
