Government of Goa exempts all the Information Technology units from various sections of the Goa, Daman and Diu Shops and Establishments Act, 1973

The State Government of Goa on November 07, 2019, has exempted all the Information Technology units including Integrated Information Technology Township, Information Technology Parks, Information Technology (IT) Companies, Information Technology Enabled Services (ITeS), Startup, Electronic Manufacturing Cluster (EMC), Industry 4.0. in the State of Goa, which are registered with Government of India under the Start-Up India programme and registered with the Start-Up Promotion Cell and IT Policy of Department of Information and Technology, Government of Goa, from the provisions of Section 8, 10, 11, 16 and 50 of the Goa, Daman and Diu Shops and Establishments Act, 1973, for a period of 5 (five) years, from the date of publication of this Notification in the Official Gazette (November 07, 2019), subject to certain conditions, namely:

Ø  overtime wages at double the ordinary rate of wages and weekly off

Ø  engagement of young person during the night shift, subject to provision of adequate security

Ø  employee shall be provided with identity cards and all the welfare measures          

Ø  Maintenance of register and records

Ø  Revocation of exemption at any time without any prior notice

The above said sections of the Goa, Daman and Diu Shops and Establishments Act, 1973 specifies, namely:

Ø  Section 8: Closing of shops and grant of holidays;

Ø  Section 10: Opening and closing hours;

Ø  Section 11: Daily and weekly hours of work;

Ø  Section 16: Young persons to work only between 6 a. m. and 7 p. m.;

Ø  Section 50: Powers and duties of Inspectors.

This Notification will come into force with immediate effect.
