Draft Designs (Amendment) Rules, 2019

The Department for Promotion of Industry and Internal Trade (DPIIT) on October 18, 2019, has published the Draft Designs (Amendment) Rules, 2019 to further amend the Designs Rules, 2001.

Some of the major amendments in the Designs Rules, 2001 are as under:

Ø  Under Rule 2 which specifies Definitions, Clause (eb) has been inserted, namely:

“startup” means:

(a)    an entity in India recognised as a startup by the competent authority under Startup India initiative; and

(b)    in case of a foreign entity, an entity fulfilling the criteria for turnover and period of incorporation/ registration as per Startup India Initiative and submitting declaration to that effect. Explanation: In calculating the turnover, reference rates of foreign currency of the Reserve Bank of India shall prevail.

Ø  Rule 5 which specifies the fee for registration of Designs:

Sub-rule 2 (e) has been substituted and clause (f) has been deleted.

Ø  Rule 10 (1) which specifies the classification of goods has been substituted.

The Draft Rules will be taken into consideration after the expiry of a period of thirty days from the date on which copies of the Gazette of India in which this notification is published, are made available to the public (that is October 18, 2019).
