FSSAI issues letter related to labeling defects on package of health supplements and nutraceuticals products

The Food Safety and Standards Authority of India (FSSAI) on September 18, 2019, has issued a letter requesting all the Food Business Operators (FBOs) to keep check on labeling defects on package of health supplements or nutraceutical products which are in contravention with Food Safety and Standards (Packaging and Labelling) Regulation, 2011. It has been noticed that some food products including nutraceutical or health supplement products which have gelatin shells or contain ingredients from animal origin but depicts green dot on their package labels and declare the same as vegetarian product, are in contravention with FSS (Packaging and Labelling) Regulation, 2011 which mandates the applicability of veg and non-veg logo on the label of pre-packed food products. This issue shall be considered as misbranding and labeling defects.

Thus, FSSAI have directed all the food products selling nutraceutical or health supplement products shall comply with the FSS (Health Supplement, Nutraceutical, Food for Special Dietary use, Food for Special Medical Purpose, Functional Food and Novel Food) Regulations, 2016 and FSS (Packaging and Labelling) Regulations, 2011. In case of default or failure to comply with the above mentioned Regulations, an appropriate action will be taken against defaulting Food Business Operators as per the provisions of Food Safety Standards Act, 2006.
