Government of Tripura amends the Tripura Contract Labour (Regulation and Abolition) Rules, 1978

The State Government of Tripura on September 02, 2019, has published the Draft Tripura Rationalization of Forms and Reports Under Certain Labour Laws Rules. 2019 for ease of and for expedient compliance of the requirements related to forms and reports in certain Labour laws.

The following amendments in certain labour laws except as respects things done or omitted to be done before such amendment, namely:

Ø  The Tripura Contract Labour (Regulation and Abolition) Rules, 1978:

(1)    Rule 4 which specifies the terms of office of Chairman of State Advisory Contract Labour Board shall be substituted

(2)    After Rule 6, the following rules, shall be inserted:

(i)                  Rule 6A: Disqualification for membership;

(ii)                Rule 6B: Removal from membership;

(iii)               Rule 6C: Vacancy;

(3)    After Rule 8, the following rules, shall be inserted:

(i)                  Rule 8A: Disposal of business

(ii)                Rule 8B: Committees of the Board

(4)    Under Rule 13 which specifies the procedure for granting registration certificate:

(i)                  In sub-rule (1) for the words and figures “in Form II”, which is related to certificate of registration, the words and figures “in Form I annexed to the Tripura Rationalization of Forms and Reports Under Certain Labour Laws Rules, 2019" shall be substituted;

(ii)                After sub-rule (1), the following sub-rule shall be added:

Sub-rule (1-A) which specifies that every certificate of registration granted shall contain certain particulars.

(5)    After Rule 13, the following Rules shall be inserted:

Rule 13A: Circumstances in which application for registration may be rejected.

(6)    Under Rule 15 which specifies the procedure for making application by a contractor for the grant of a licence:

(i)                  Under sub-rule (1), Form IV which is related to an application by a contractor for the grant of a licence, shall be substituted with Form II of the Tripura Rationalization of Forms and Reports Under Certain Labour Laws Rules, 2019;

(ii)                Under sub-rule (2), Form V which is related to certificate by the principal employer regarding the applicant has been employed by him as a contractor, shall be substituted with Form III of the Tripura Rationalization of Forms and Reports Under Certain Labour Laws Rules, 2019.

(7)    Under Rule 19 which specifies Forms and terms and conditions of licence:

(i)                  Under sub-rule (2), after clause (v), the following clauses shall be inserted:

(a)    Clause (vi): Every establishments shall provide two rooms of reasonable dimensions for the use of the children under the age of six years, where twenty or more women are ordinarily employed as contract labour;

(b)    Clause vii: the licensee shall notify any change in the number of workmen or the conditions of work to the licensing officer;

(c)     Clause viii: The licensee shall, within fifteen days of the commencement and completion of each contract work submit a return to the Inspector in Form VII of the Tripura Rationalization of Forms and Reports Under Certain Labour Laws Rules, 2019;

(d)    Clause ix: a copy of the licence shall be displayed prominently at the promises whore the contract work is being carried on;

(e)    Clause x: no female contract labour shall be employed by any contractor before 6.00 a.m. or after 7.00 p.m.

(8)    Rule 20 which specifies the fees to be paid for grant of a certificate of registration, shall be substituted.

(9)    Rule 23 which specifies the procedure for Renewal of licence, the Form VII related to renewal of license shall be substituted with Form II of the Tripura Rationalization of Forms and Reports Under Certain Labour Laws Rules, 2019.

(10) Rule 26 which specifies the procedure for Grant of temporary certificate of registration and licence shall be omitted;

(11) Under Rule 65 which specifies the Employment Card, the Form XV in which contractor shall issue an employment card, shall be substituted with Form VIII of the Tripura Rationalization of Forms and Reports Under Certain Labour Laws Rules, 2019.

(12) Forms II, IV, V, VI, VII, VIII, IX. X, XI, XIV and XV shall he omitted:

(i)                  Form II: A certificate of registration;

(ii)                Form IV: Application for licence;

(iii)               Form V: Form of certificate by principal employer 

(iv)               Form VI: Grant of licence;

(v)                Form VII: Application for Renewal of Licences;

(vi)               Form VIII: Application for temporary registration of establishments employing contract labour;

(vii)             Form IX: Temporary Certificate of Registration;

(viii)           Form X: Application for Temporary Licence

(ix)               Form XI: Grant of temporary certificate of registration and licence;

(x)                 Form XIV: Employment Card;

(xi)               Form XV: Service Certificate.

The objections or suggestions will be taken into consideration after the expiry of a period of one month from the date on which the copies of the Official Gazette of this Notification are made available to the public (September 04, 2019).
