Government of Andhra Pradesh amends Andhra Pradesh Excise (Grant of Licence of Selling by Shop and Conditions of Licence) Rules, 2019

The State Government of Andhra Pradesh on September 13, 2019, has made amendment in Rule 19 of the Andhra Pradesh amends the Andhra Pradesh Excise (Grant of Licence of Selling by Shop And Conditions of Licence) Rules, 2019.

Rule 19 has been substituted, namely:

Rule 19: Employment of servants:

(1)The following shall be the age, educational qualifications and other requirements in respect of Shop Supervisors and Shop Salesmen:

(i)Minimum age 21 years and maximum age 40 years;

(ii)Degree, preferably B.Com., with computer knowledge for Shop Supervisors and Intermediate for Shop Salesmen;

(iii)Must be native of the Mandal/Local body in which the Shop is located. 

(2)The following persons shall not be employed as Shop Supervisors and Shop Salesmen:

(i)Women;

(ii)Persons convicted of any offence under the provisions of the A.P. Excise Act, 1968 or the Narcotic Drugs and Psychotropic Substances Act, 1985 within the preceding three years;

(iii)Persons convicted under Sections 482 to 489 of the Indian Penal Code, 1860:

The above mentioned Sections detail description, namely:

i.Section 482: Punishment for using a false property mark;

ii.Section 483: Counterfeiting a property mark used by another;

iii.Section 484: Counterfeiting a mark used by a public servant;

iv.Section 485: Making or possession of any instrument for counterfeiting a property mark;

v.Section 486: Selling goods marked with a counterfeit property mark;

vi.Section 487: Making a false mark upon any receptacle containing goods;

vii.Section 488: Punishment for making use of any such false mark;

viii.Section 489: Tampering with property mark with intent to cause injury.
