Draft Geographical Indications of Goods (Registration and Protection) (Amendment) Rules, 2019

The Ministry of Commerce and Industry on September 12, 2019, has published a draft Geographical Indications of Goods (Registration and Protection) (Amendment) Rules, 2019.

The amendments made in the Geographical Indications of Goods (Registration and Protection) Rules, 2002 are:

 Rule 56(1) has been substituted stating that an application to the Registrar for the registration by a producer as an authorized user of the registered geographical indication shall be made by the proposed authorized user in Form GI-3 and shall be accompanied by a Statement of Case of how he claims to be the producer of the registered geographical indication. The applicant shall also forward a copy of the application to the registered proprietor, and intimate the Registrar of due service of the same.

 Rule 59(1) has been substituted stating where no notice of opposition is filed to an application advertised or re-advertised in the journal within the period specified under Section 17(3)(e) or where an opposition is filed and it is dismissed, the Registrar shall enter the authorised user in Part B of the register and shall issue a registration certificate with the seal of Geographical Indication Registry.

 The First, Second Schedule and Form GI 3 shall be substituted.

Any person likely to be affected thereby by the draft, are requested for objections or suggestions, if any, within thirty days from the date on which the copies of this notification as published in the Gazette of India, are made available to the public.
