The Ministry of Mines on August 13, 2019, has published the Mineral Conservation and Development (Amendment) Rules, 2019, to further amend Rule 35 of the Mineral Conservation and Development Rules, 2017, which specifies that every holder of a mining lease shall take all possible precautions for undertaking sustainable mining.

Under Rule 35:

Ø  Sub-rule (4) has been substituted, namely:

The Regional Controller or the authorised officer of the Indian Bureau of Mines may suspend the mining operations in those mines where at least three star rating has not been achieved within a period of four years with effect from the 27th February, 2017 or four years from the date of commencement of mining operations, as the case may be, after giving a show cause notice of forty-five days, to qualify for star rating.

Ø  In sub-rule (5), the words “three star rating” has been substituted instead of the words “four star rating”.

They will come into force on the date of their publication in the Official Gazette.
