Tamil Nadu Clinical Establishments (Regulation) Amendment Act, 2019

The State Government of Tamil Nadu on July 20, 2019, has published the Tamil Nadu Clinical Establishments (Regulation) Amendment Act, 2019, to further amend the Tamil Nadu Clinical Establishments (Regulation) Act, 1997.

The following amendments in the Tamil Nadu Clinical Establishments (Regulation) Act, 1997, are as under:

Under Section 3 which specifies the procedure for registration of private of clinical establishments:

Ø  First and second proviso of sub-section (1) has been substituted:

Amended proviso:

Provided that every clinical establishment in existence on the date of the commencement of the Tamil Nadu Private Clinical Establishments (Regulation) Amendment Act, 2018, shall apply for registration within fifteen months from the notified date and a clinical establishment established after the notified date, shall apply for registration within a period of six months from the date of its establishment:

Provided further that every clinical establishment in existence on the notified date shall cease to carry on its business on the expiry of eighteen months from the notified date unless such clinical establishment has applied for registration and is so registered or till such application is disposed of, whichever is earlier.

Ø  Under sub-section (2), the following proviso shall be added, namely:

Provided that no fee shall be collected from the clinical establishments established and administered or maintained by the State Government or Central Government or any Departments of the State Government or Central Government or a company owned or controlled by the State Government or Central Government or a local authority.

However, the State Government of Tamil Nadu has received representations from the existing clinical establishments to extend the period for registration of clinical establishments.   The Government has therefore decided to extend the period for registration of existing clinical establishments for a further period of six months that is in section 3(1): first proviso from nine months to six months and in second proviso from twelve months to eighteen months. Further, the clinical establishments run by State, central and Quasi Government are rendering medical care facilities to the poor at free of cost.  Therefore, the State Government of Tamil Nadu has decided to exempt the said clinical establishments from the payment of registration fee.
