Indian Medical Council (Amendment) Act, 2019

The Legislative Department on July 16, 2019, has published the Indian Medical Council (Amendment) Act, 2019, to further amend the Indian Medical Council Act, 1956.

The following amendments in the Indian Medical Council Act, 1956 are as under:

Under Section 3A which specifies the Power of Central Government to supersede the Council and to constitute a Board of Governors:

Ø  In Sub-section (2), for the words "three years", the words "two years" shall be substituted;

Ø  In sub-section (4):

a)      for the words "seven persons", the words "twelve persons" shall be substituted;

b)      for the words "and medical education", the words "and medical education or proven administrative capacity and experience" shall be substituted;

Ø  After sub-section (7), the following sub-section shall be inserted, namely:

Sub-section (7A): The Board of Governors shall be assisted by a Secretary General who shall be appointed by the Central Government on deputation or contract basis and he shall be the head of the secretariat in the Council.

The provisions of this Act shall, except section 2(c)(i), be deemed to have come into force on September 26, 2018 and section 2(c)(i) shall be deemed to have come into force on January 12, 2019.


The Indian Medical Council (Amendment) Second Ordinance, 2019 is repealed.
