Jul 04, 2019 | by Avantis RegTech Legal Research Team

The Food Safety and Standards Authority of India (FSSAI) on July 01, 2019, have launched a special drive for licensing and registration of food businesses. FSSAI had observed certain non-compliances like license or registration in wrong categories, continuance of business with expire licenses or without any license etc.

Thus, the FSSAI has proposed to launch a special drive to address four types of non-compliance mentioned below:

1. FBOs who have obtained registration certificate despite being required to obtain a license.

2. FBOs continuing food business with expired or without license.

3. FBOs who have obtained fresh license or registration instead of renewing the previous one, to avoid penalty.

4. FBOs manufacturing or processing food products which are not endorsed on their license.

The Special drive will be implemented in two phrases:

• The First phrase (July 01, 2019 – September 30, 2019) - FSSAI has launched Food products Identity Verification System (FPIVS) [https://fssai.gov.in/fpivs] for the FBOs to verify whether the products endorsed in License, which are being manufactured. FBOs can access the details of their license or registration on FSSAI website https://foodlicensing.fssai.gov.in/knowfssailicense/.

• The Second phrase (from October 01, 2019) – Enforcement activities will be taken up against the defaulting FBOs under the FSSAI Act, Rules, Regulations.

The monthly report on Special Drive for licensing and registration of food business have to submit within first week of the succeeding month from July, 2019 onwards to FSSAI in the format prescribed in Annexure-II (Page 4).
