The Department for Promotion of Industry and Internal Trade (DPIIT) on May 31, 2019, has published Draft Patents (Amendment) Rules, 2019, to further amend the Patents Rules, 2003 and for the information of all persons likely to be affected.

The Draft Rules will be taken into consideration after the expiry of a period of thirty days from May 31, 2019. Objections or suggestions, if any, may be addressed to Shri Sushil K Satpute, Director, DPIIT, Ministry of Commerce and Industry, Government of India, Udyog Bhawan, New Delhi-110011 or by e-mail at [email protected]

The following amendments in the Patents Rules, 2003 are as under:

• Under Rule 21 which specifies the procedure for filing of the priority document, Sub-rules (2) and (3) has been substituted.

• Under Rule 131 which specifies the Form and manner in which statements required under section 146(2) to be furnished, sub-rule (2) has been substituted.

• Under the Second Schedule, Form 27 is the Statement regarding the working of the patented invention on commercial scale in India, has been substituted.
