Ministry of Civil Aviation publishes Draft Aircraft (Amendment) Rules, 2019

The Ministry of Civil Aviation on May 01, 2019, has published the Draft of ‘Aircraft (Amendment) Rules, 2019’ to further amend the Aircraft Rules, 1937 and to give information to persons likely to be affected.

Draft rules will be taken into consideration after a period of thirty days from the date on which copies of the Gazette of India, in which the Notification is published, are made available to the public that is May 15, 2019.

Objections or suggestions, if any, may be addressed to the Director-General of Civil Aviation, Opposite Safdarjung Airport, New Delhi-110003 or mailed to [email protected];

Some of the major amendments in the Aircraft Rules, 1937, are as under:

(A) In rule 93 which specifies the requirement of a license for air traffic services personnel:

(i) after sub-rule (1), the following proviso shall be inserted, namely:

“Provided that any person already engaged in the provision of air traffic services before the commencement of the Aircraft (Sixth Amendment) Rules, 2018, may continue to provide such services in accordance with the procedure specified by the Director-General till such person obtains the licence or till a date to be notified by the Central Government, whichever is earlier.”;

(ii) the proviso under sub-rule (2) shall be omitted;

(B) Rule 112(3)(a) which specifies the test, assessment and examination, will be substituted.
