Food Safety and Standards (Fortification of Foods) Amendment Regulations, 2019

Food Safety and Standards Authority of India (FSSAI) on February 04, 2019 passed a draft Notification to amend certain Regulations in Food Safety and Standards (Fortification of Foods) Regulations, 2018. The Amended Regulation may be called as Food Safety and Standards (Fortification of Foods) Amendment Regulations, 2019. It will come into force on the date of publication in the Official Gazette.

Under Regulation 2(1) of the Regulation, 2018 which talks about the “Definition”, a new regulation 2(1)(da) defining “fortified processed foods” has been inserted .

Under Regulation 3(1) of the Regulation, 2018, followings clauses has been inserted. Those are:

·         Fortified Processed Foods may be prepared from fortified food articles that may becereals and/or milk [Regulation 3(1)(f)]

·         The Fortified Processed Food shall provide 15-30 % of the Indian adult RDA of micronutrient based on an average calorie intake of 600 kcal from processed foods (~1/3of energy of 2000 kcal); [Regulation 3(1)(g)]

·         High Fat Sugar Salt (HFSS) Foods shall be excluded from Fortified Processed Foods category. [Regulation 3(1)(h)]

Under Regulation 4 of Regulation, 2018, a new Regulation has been inserted, namely:

·         Any manufacturer who fortifies any processed food shall ensure that the level of micronutrient in such fortified processed food does not fall below the minimum level specified in Schedule-III. [Regulation 4(2)]

A new SCHEDULE-III: “Standards for Fortified processed foods” has been also inserted.
