FSSAI directs Food Commissioners to check Labelling Defects on package of Health Supplements and Nutraceutical Products

The Food Safety and Standards Authority of India (FSSAI) has been reported that Nutraceutical/Health Supplement products which have gelatin shells or contain ingredients from animal origin depicts green dot on their package labels and declare the same as vegetarian product. This is in contravention of Food Safety and Standards (Packaging and Labeling) Regulation, 2011, which mandates the applicability of veg/non-veg logo on the label of pre-packed food products and same, shall be considered as misbranding and labeling defects.

The Authority has stated that all the food products falling under the category of Nutraceutical/Health Supplement shall have to comply with the Food Safety and Standards (Health Supplements, Nutraceutical, Food for special Dietary Use, Food for Special Medical Purpose, Functional Food and Novel Food) Regulations, 2016 as well as the Food Safety and Standards (Packaging and Labeling) Regulation, 2011, failing which will attract the penal provisions under FSS Act, 2006.

To ensure compliance of the relevant Regulations, the FSSAI has directed all Commissioner of Food Safety in all States to initiate strong enforcement drive to keep check on the sale of such food products in their area of jurisdiction which are in contravention with FSS (Packaging and Labelling) Regulation, 2011 and initiate appropriate action against the defaulting Food Business Operators as per the provisions laid down under FSS Act, 2006, Rules and Regulations, 2011 made thereunder.
