FSSAI publishes Draft Food Safety and Standards (Food Products Standards and Food Additives) Amendment Regulations, 2018

The Food Safety and Standards Authority of India (FSSAI) on December 12, 2018 has published the Draft Food Safety and Standards (Food Products Standards and Food Additives) Amendment Regulations, 2018 to further amend the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 and for the information to all persons likely to be affected thereby.

Notice has been given that the draft regulations shall be taken into consideration after the expiry of the period of thirty days from the date on which copies of the Gazette containing this notification are made available to the public i.e. December 12, 2018.

Objections or suggestions, if any, may be addressed to the Chief Executive Officer, FSSAI, FDA Bhawan, Kotla Road, New Delhi- 110002 or sent on email at [email protected]. Objections or suggestions, which may be received from any person with respect to the draft regulations before the expiry of period so specified, shall be considered by FSSAI.

Some of the major amendments in the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 are as under:

·         In regulation 1.2, for clause (17) which define Refined Vegetable Oil shall be substituted;

·         In Regulation 2.2:

o   In Clause (2)(3)(6)(7)(8)(10)(10.1)(12)(13) of  Regulation 2.2.1 certain words and figures shall be omitted and Clause(22) which specifies Blended Edible Vegetable oils, Clause (22.01) Table and Clause 16 which defined Refined vegetable oil shall be substituted.

o   In Sub-regulation 2.2.2 which specifies Interesterified vegetable fat:

In clause (iii), the proviso shall be omitted and clause (v) shall be substituted.

o   In Sub-regulation 2.2.3 which define Partially Hydrogenated Soyabean Oil:

In clause (1) and (2), after the last paragraph, the following words and figures shall be inserted, namely:

“The oil shall not contain trans fatty acids more than 5 % by weight: Provided that maximum limit of trans fatty acid shall not be more than 3% by weight, on and from 1st January, 2021 and not more than 2% by weight, on and from 1st January, 2022.”

o   In Sub-regulation 2.2.5 which define Margarine and Fat Spreads:

a.       In clause (1), after the last paragraph, the following words and figures shall be inserted, namely:

“It shall not contain trans fatty acids more than 5 % by weight: Provided that maximum limit of trans fatty acid shall not be more than 3% by weight, on and from 1st January, 2021 and not more than 2% by weight, on and from 1st January, 2022.”

b.      In clause (2), sub-clause (ii) and the proviso shall be substituted

c.       in clause (3), in the paragraph beginning with the words “The Fat content” and ending with the words “the total fat content” the following words and figures shall be inserted, namely:

“The Vegetable fat spread and mixed fat spread shall not contain trans fatty acids more than 5 % by weight. Provided that maximum limit of trans fatty acid shall not be more than 3% by weight, on and from 1st January, 2021 and not more than 2% by weight, on and from 1st January, 2022.”

o   In Sub-regulation 2.2.6 which specifies Hydrogenated Vegetable Oils:

a.       In clause (1):

1.       in sub-clause (iii), the proviso shall be omitted;

2.       In sub-clause (vii), the item (b) and the proviso shall be substituted.

b.      in clause (2), sub-clause (a) and the proviso shall be substituted

·         In Regulation 2.3 which specifies Fruit & Vegetable Products:

o   in sub regulation 2.3.1

a.       In first paragraph after the words “so as to prevent spoilage.”, the following shall be inserted, namely: “Cherries may contain stems and shall be labelled accordingly.”

b.      after item (ii), the following shall be inserted, namely:

“In case of cherries with stems, drained weight of the cherries shall be calculated after removal of the stem from the cherries.”

o   Sub regulation 2.3.6 relating to “Thermally processed fruit Juices” shall be substituted.
