Draft Food Safety and Standards (Packaging and Labelling) Amendment Regulations, 2018

The Food Safety and Standards Authority (FSSAI) on October 08, 2018 has published the Draft Food Safety and Standards (Packaging and Labelling) Amendment Regulations, 2018 to further amend Food Safety and Standards (Packaging and Labelling) Regulations, 2011.

The Draft Food Safety and Standards (Packaging and Labelling) Amendment Regulations, 2018 has been published for the information of all persons likely to be affected there by and notice has been given that the said draft regulations shall be taken into consideration after the expiry of the period of thirty days from the date on which copies of the Official Gazette in which this notification has published are made available to the public.

The amendments in the Food Safety and Standards (Packaging and Labelling) Regulations, 2011 are as under:

In regulation 2.4 which specifies the Specific Requirements/ Restrictions on manner of labelling, after sub-regulation 2.4.4 which specifies the provisions regarding Labelling of irradiated Food, the following sub-regulation shall be inserted, namely:

2.4.5: Display of information in food service establishments:

(1) Food Service Establishments having Central license or outlets at 10 or more locations shall display the calorific value of each of the food items sold by them on their menu cards or boards. Additionally, reference information on the requirements of 2000 Kcal energy for an average adult per day shall also be displayed clearly and prominently.

(2) Food Service Establishments shall display the information specified below at the point of sale or service of the food:

(a)    Any warning/gluten free and low gluten status in food; and

(e)    Information relating to statutory declarations required under these regulations;

(b)    Information relating to allergens in the food; 

(c)     Logo for veg or non-veg;

(d)    Information relating to organic food or ingredients. 

(3) E-commerce Food Business Operators shall also provide this information in the menu linked with each food service establishment on their platform, where applicable.

(4) These provisions shall not be applicable to the following:

  (a) Event caterers and Food Service premises that operate for less than 60 days in a calendar year (consecutively or non-consecutively).

  (b) Self-serve condiments that are free of charge and not listed on the menu.

  (c) Special-order items or modified meals and menu items as per customer’s request.

(5) Food Service Establishments shall also keep written nutritional information on the food items sold by them in the form of booklets or handouts or on their website which shall be provided to consumers upon request.

Objections or suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, FDA Bhawan, Kotla Road, New Delhi-110002 or sent on email at [email protected] ; The objections and suggestions, which may be received from any person with respect to the said draft regulations before the expiry of the period so specified, will be considered by the Food Authority.

The Regulations shall come into force on the date of their final publication in the official Gazette.
