Licensing of FBOs having establishments at Seaports and Airports

The Food Safety and Standards Authority of India (FSSAI) has passed the Office Orders dated November 20, 2015 and July 18, 2016 wherein the following were conveyed:

(i)                 Licenses for Food Business Operators (FBOs) having establishments within the Seaport and Airport premises that is, within Port/Airport Terminals for which Designated Officers (PHOs/APHOs) have been notified under FSS Act, 2006, would be issued by the respective Designated Officers.

(ii)               Licenses for FBOs having establishments within the Seaport and Airport premises that is, within Port/Airport Terminals for which Designated Officers (PHOs/APHOs) have not been notified under FSS Act, 2006, would be issued by respective Central Licensing Authority.

(iii)             All licenses already issued by State DOs at Seaports/Airports will be modified by notified PHOs/APHOs as Designated Officers of Seaports/Airports and Central Licensing Authorities at the time of renewal of existing licenses with renewal fee but without charging any fees for modification.

(iv)              Licenses for FBOs having establishments outside the Seaport and Airport premises that is, outside Port/Airport Terminals would be issued by the respective State Designated Officer/Central Licensing Authority as per the capacity/turnover of the food business.

However, it has come to the notice of FSSAI that despite above Office Orders in existence, Licenses for FBOs having establishments at Seaports and Airports, for which PHOs/APHOs as Designated Officers have either been notified or not notified under FSS Act, 2006 (e.g. Lucknow, Raipur), have been issued/renewed by the State DOs instead of PHOs/APHOs and CLAs.

In view of the above, Licenses of all such FBOs whose Licenses were issued/renewed inadvertently by the State DOs need to be modified immediately. Accordingly, all such FBOs may be advised to surrender their existing licenses and apply afresh for FSSA1 License to the concerned PHO/APHO notified as Designated Officers of Seaports/Airports or CLAs in cases where Designated Officers have not been notified under FSS Act, 2006 by depositing the fee prescribed for Central License. A report in this regard may be sent to this office by April 30, 2018.
