Food Safety and Standards (Food Products Standards and Food Additives) Fifteenth Amendment Regulations, 2018

The Food Safety and Standards Authority of India (FSSAI) on November 26, 2018 has published Food Safety and Standards (Food Products Standards and Food Additives) Fifteenth Amendment Regulations, 2018 to further amend the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011.

The draft of Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 was published vide Notification number File No. 1-116/Scientific Committee (Noti.)/2010-FSSAI, dated April 10, 2018 inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of a period of thirty days from date on which the copies of the official Gazette containing the notification was made available to the public i.e. April 26, 2018.

Whereas objections and suggestions received on the draft regulations have been considered by the FSSAI and some of the major amendments has been made to Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, they are under:

In regulation 2.5 which specifies Meat and Meat products:

(i)                  in sub-regulation 2.5.2, for clause 7, the following clauses shall be substituted, namely:

o   7. FRESH OR CHILLED OR FROZEN PORK OR PIG MEAT;

o   8. FRESH OR CHILLED OR FROZEN BEEF;

o   9. FRESH OR CHILLED OR FROZEN CHEVON OR GOAT MEAT;

o   10. FRESH OR CHILLED OR FROZEN MUTTON OR SHEEP MEAT;

o   11. FRESH OR CHILLED OR FROZEN POULTRY MEAT

(ii)                After sub-regulation 2.5.2 of the said regulations, the following sub-regulation shall be inserted, namely:

2.5.3 Egg and Egg Products:

(iii)               In regulation 2.6 which specifies Fish and Fish Products, of the regulations, in sub-regulation 2.6.1, after clause 17, the following clauses shall be inserted, namely:

o   18. Live and Raw Bivalve Molluscs

o   19. Sturgeon Caviar

o   20. Fish Sauce

o   21. Quick Frozen Fish Sticks (fish fingers), Fish Portions and Fish Fillets - Breaded or Battered

o   22. Fresh and Quick Frozen Raw Scallop Products

(iv)              In regulation 2.12 which specifies Proprietary Food, in sub-regulations 2.12.1, clause (2) shall be substituted.

The Regulation shall come into force on the date of their publication in the Official Gazette and Food Business Operator shall comply with all the provisions of the regulations by July 01, 2019.
